THIS INFORMED CONSENT, WAIVER AND TERMS OF PARTICIPATION (“Consent” or “Agreement”) is made between Humanley (being Daniel Roytas and/or any entity through which the course is operated or controlled) and the Participant. The course (Elements) is provided solely for general educational and informational purposes. It is not medical, clinical, diagnostic or therapeutic advice, and no result, improvement, cure or outcome of any nature is represented or guaranteed. The Participant must consult their treating doctor or primary health care provider before relying on or implementing any information from the course. The Participant acknowledges that participation is voluntary, they may withdraw at any time, attendance is not mandatory, and Humanley bears no responsibility if the Participant does not attend or complete the course. The course is delivered online via humanley.com using a mix of pre-recorded and live content and access is granted for twelve (12) weeks only. Humanley endeavours to present accurate information but does not guarantee accuracy or completeness; the Participant accepts responsibility to verify information independently or through a qualified professional.
All course material, recordings and content are the exclusive property of Humanley and must not be copied, shared, reproduced or made available to third parties. A refund may be requested within fourteen (14) days of purchase; after that no refund is available for change of mind, non-completion or withdrawal, without limiting any non-excludable rights under the Australian Consumer Law to the extent they apply. The Participant accepts all risks arising from exposure to, reliance on or use of course information and participates entirely at their own risk.
To the fullest extent permitted by law, the Participant releases and forever discharges Humanley from all claims, demands, liabilities, losses or damages connected with participation in the course, waives any right to claim against Humanley in relation thereto, and indemnifies and holds Humanley harmless against all actions, claims, costs, losses or liabilities (including legal costs on a full indemnity basis) arising out of reliance on course content, breach of this Agreement, use or misuse of the material, or any act or omission of the Participant. Any dispute must first be submitted to mediation conducted in or under the laws of Australia; if unresolved after mediation, the courts of Australia have exclusive jurisdiction and Australian law governs this Agreement. The Participant agrees to and incorporates by reference the Terms & Conditions and Privacy Policy on humanley.com.
This Agreement constitutes the entire arrangement between the parties. If any provision is invalid, the remainder continues in force. Variation is only effective if made in writing by Humanley. By signing or electronically accepting, the Participant declares their country of residence to be true and correct and agrees that typing their name constitutes a legally binding digital signature.
